ESMA - Transitional provisions under the BMR review
ESMA has published an updated version of its Public Statement on the transitional provisions under the BMR review.
Benchmarks within the scope of the BMR, provided by third-country administrators that submitted an application to ESMA for recognition or endorsement by 31 December 2025, may continue to be used in the EU while their application is under review, unless such application is refused by ESMA.
Administrators of benchmarks already included in the ESMA register as authorised, registered, recognised or endorsing entities will retain their status until 30 September 2026 and are not required to reapply in the EU if they fall within the scope of the revised BMR by that date.
In addition, competent authorities may continue to designate benchmarks as significant until 30 September 2026
